A Batavia man who allegedly broke into a woman’s house and held a knife to her neck had been released from custody only an hour earlier.
More details were made available regarding the Oct. 23 arrest of John Sumlin III, 43, of West Main Street.
Sumlin had been charged by Genesee County sheriff’s deputies with first-degree burglary, a violent felony offense punishable by up to 25 years in prison, felony criminal contempt of court, felony criminal mischief and misdemeanor counts of third-degree assault and menacing.
The charges came after Sumlin allegedly entered the woman’s house about 5:30 a.m. Oct. 23, held a knife to her neck and threatened to kill her and her children, deputies said.
The woman had an order of protection against Sumlin that was put in place an hour earlier.
City police, in a report released Monday, said officers responded to a complaint at 1:46 that same morning. Sumlin was accused of hitting the woman, his girlfriend, in the neck during an argument.
City police charged Sumlin with harassment and misdemeanor criminal possession of a controlled substance.
According to the report, Sumlin was arraigned in City Court and an order of protection was issued at 4:16 a.m.
Sumlin was, however, jailed after the arrest by sheriff’s deputies.
He remains in Genesee County Jail pending a court appearance.
